NOVA PASS General Terms and Conditions

NOVA PASS mobile application (“NOVA PASS”) is managed and operated by Nova Credit Limited (“NOVA”), a Selected Credit Reference Agency under the Multiple Credit Reference Agency Model (Credit Data Smart).

By installing and using NOVA PASS, you are deemed to have accepted and agreed to these terms and conditions and any change thereof.

1. You warrant and represent that you are acquiring or seeking to acquire only your own credit report and other consumer credit data. All information you provide through NOVA PASS is true and accurate. You shall comply with all applicable laws and regulation when using NOVA PASS.

2. You shall not modify, create derivative works, decompile, reverse engineer, disassemble, decrypt or otherwise attempt to derive the source code of NOVA PASS.

3. NOVA may require you to verify your identity by one or more of the following in order to ensure account security and to comply with applicable laws and regulations:-
a. passing verification of your Hong Kong identity card;
b. passing verification of your mobile phone number and email address;
c. passing facial recognition verification which compares your facial features lively captured with your facial image on your Hong Kong identity card; and/or
d. passing such measures as NOVA may deem necessary.

4. NOVA may suspend or otherwise terminate your account and/or use of NOVA PASS if any of the following events occurs:-
a. we believe that you may be involved in any default or breach of these terms and conditions or any applicable laws and regulations;
b. you fail or refuse to provide the documents and/or information as may be reasonably requested by NOVA;
c. any information you provided is inaccurate, incomplete or misleading;
d. we have identified or received a report of any suspicious or other abnormal activities or transactions relating to your NOVA PASS account and/or your consumer credit data; or
e. provision of any service to you is prohibited by law, regulatory order or court order.

5. By requesting for your credit report, you authorise and consent to NOVA to access and use any or all of your consumer credit data retained in NOVA’s system (“Credit Information”) and match such information with any information you provide to NOVA.

6. The Credit Information may be provided and updated by credit providers and/or other sources of information. NOVA does not warrant, represent or guarantee the accuracy, reliability, timeliness, completeness, relevance or fitness for any purpose of the Credit Information.

7. NOVA PASS is available on an “as-is” basis without any warranty, express or implied. NOVA expressly disclaims any and all warranties including but not limited to any warranty or representation regarding the operation of NOVA PASS, the availability, accuracy or content of any information of services provided or available through NOVA PASS. NOVA shall not be liable for any loss or damages suffered as a result of or in connection with the use of or reliance upon the information available through NOVA PASS.

8. You agree that the information you provide to NOVA will be kept at NOVA’s system and/or your mobile phone and used for customer service purposes regardless of whether or not you have requested for or acquired a credit report.

9. All payment made through NOVA PASS is non-refundable and non-transferable unless stated otherwise.

10. NOVA does not warrant, represent or guarantee that NOVA PASS will be secure, free from error, bugs or viruses free or operate without interruption or delay. You are responsible for the security configurations or settings of your own mobile devices. You may save a copy of your credit report and other information if required and NOVA is not responsible for any loss of data.

11. You shall ensure that the login credentials including passwords are kept in a secure and confidential manner. You are responsible for changing the login password regularly.

12. NOVA shall not be liable for any error, omission, inaccuracy, loss or damage arising from or in relation to the use of NOVA PASS.

13. You agree to indemnify and hold NOVA and/or its shareholders, directors, officers, employees, agents or licensors harmless from and against any claim, suit, demand, action or other proceedings brought by third parties as a result of your breach of these terms and conditions.

14. You agree that NOVA may use your personal information, device attributes and Credit Information to detect or investigate misuses, frauds, identity thief or any other crimes. NOVA will do so only if it is required under any law, regulation, court order or internal compliance policy.

15. You agree for NOVA to access and use your Credit Information stored at NOVA’s system and/or your mobile phone from time to time for the purpose of providing mobile application services, including but not limited to alert service, credit dashboard, notification and other services and/or enhancing your user experience.

17. All trademarks and contents of NOVA PASS are owned by NOVA and/or its affiliates, suppliers, vendors, licensors, agents and other third parties. No one may copy, distribute, publish or otherwise use the trademark and contents without the prior written consent of NOVA and/or its affiliates, suppliers, vendors, licensors, agents and other third parties.

18. You shall not assign or transfer any of your rights and obligations to any third party without the prior written consent of NOVA. No one other than you and NOVA shall have any rights under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the laws of Hong Kong) to enforce these terms and conditions.

19. NOVA reserves the right to amend these terms and conditions without prior notice to you. Your continued use of NOVA PASS constitutes acknowledgement and agreement by you of the latest terms and conditions and their amendments.

20. These terms and conditions shall be governed by and construed in accordance with Hong Kong law. Any disputes shall be submitted to the exclusive jurisdiction of Hong Kong courts.

21. If any terms and conditions is held by a court of competent jurisdiction to be illegal, invalid or unenforceable, that provision shall be deemed severable and deleted from these terms and conditions and the remaining provisions shall remain in full force and effect.

22. In case there is any inconsistency between the English version and the Chinese version of these terms and conditions, the English version shall prevail.
